Family Files Wrongful Death Lawsuit Against Apartment Complex, Gas Station Alleging Negligent Security Led to Young Mother’s Death
The family of a 19-year-old mother has filed a wrongful death personal injury lawsuit against an apartment complex and a gas station near where the decedent was killed. The shooting took place in Atlanta during what the plaintiff’s attorneys have described as a “large party with no security.” As a result of the shooting and the lawsuit, one of the companies, RaceTrac, has decided to permanently close its doors. However, attorneys for the family say that shutting down is simply not enough and that the 19-year-old’s death was preventable had the company paid for security. Attorneys for the family are now attempting to hold the companies accountable for a lack of security.
According to the lawsuit, the 19-year-old mother was shot and killed as she was leaving the RaceTrac gas station on Piedmont Rd. Attorneys say that gunfire erupted during a large party at the apartment complex which is also named as a defendant in the lawsuit. As a result of the gunfire, four people were shot, two of whom were Georgia State University students. Attorneys filed the lawsuit just four days after a 21-year-old was murdered at the same exact spot.
When reached for comment RaceTrac indicated that the death did not occur on their property.
Negligent security lawsuits in Atlanta, GA
A negligent security lawsuit is a type of premises liability lawsuit which is filed on the grounds of a lack of security. Like all premises liability lawsuits, the plaintiff must establish that the property owner was negligent for the death or injury caused on their property. In most cases, negligence is established by proving that the dangerous condition was foreseeable and that the injury or death was thus preventable. In this case, attorneys for the families have argued that there were at least two other shootings at the same location prior to the 19-year-old’s death. There were a total of four shootings near the gas station.
The gas station will argue that it is not responsible for the shooting and could not have prevented the young woman’s death. They will lay the blame squarely at the feet of the apartment complex where the party took place. As a plaintiff, this is a good situation to be in. Instead of being blamed for your own injuries, you have a defendant blaming the other defendant.
Whether or not the gas station can be held liable in this case, it is likely that the owner of the apartment complex from which the gunfire erupted contributed negligence to the young woman’s death. The plaintiffs will argue that, had the property owner provided security to the apartment complex, the party would have never turned violent.
