Georgia Native Files $10 Million Lawsuit Against Trucking Company After Rear-End Collision

Truck10

A Georgia man has filed a $10 million lawsuit after he says he was badly injured when his pickup truck was rear-ended by a semi-truck owned and operated by an amusement rides company.

According to the lawsuit, a truck owned by Awesome Amusements Inc. “suddenly and without warning of any kind” rear-ended the plaintiff’s vehicle on March 27, 2023, on I-16 west of Savannah after the plaintiff had slowed down because of traffic. The plaintiff’s head struck and shattered his pickup truck’s back window. He ended up suffering a range of injuries, according to the lawsuit. The Columbus, GA man is now disabled, his lawsuit states, and has required “extensive medical care, surgeries, and therapy costing hundreds of thousands of dollars. He will need further care moving forward, the complaint states.

Elements of negligence

The plaintiff contends that the truck driver for Awesome Amusements Inc. was following too closely, speeding, and “engaged in activities that distracted him.” This is a common accident for semi-truck drivers. Traffic slows because of a stalled vehicle but the truck, which is moving too quickly, cannot stop in time because the driver (generally speaking) was not paying careful enough attention to the road.

The results of such accidents can be devastating. Individuals have died in rear-end collisions with semi-trucks before. These incidents happen frequently enough that you’ll find articles all across the internet concerning big-rigs that rear-ended commuter vehicles and caused serious personal injury.

From the perspective of the defense, there isn’t a lot they can say. On the issue of which party caused the accident, you cannot blame the plaintiff in any way. Generally speaking, the driver of a rear-ending vehicle is 100% liable for any accident they cause. While there are exceptions and caveats to this rule, it’s generally true that a rear-ending vehicle is always responsible for the accident.

Injuries and damages

In this case, the plaintiff was severely injured. We don’t know the specifics behind his injuries, but we can guess that he suffered a traumatic brain injury when his head struck the back window of his pickup truck, shattering the glass. This has, in turn, likely prevented him from working. Plus, he’s accrued hundreds of thousands of dollars in medical expenses. Lastly, his quality of life is unlikely to be the same after this accident. Those are all compensable injuries.

The plaintiff is entitled to recover his medical expenses from the company that owns the truck. In addition, he can recover damages for lost wages if he’s no longer able to do his job. Finally, the reduction in his quality of life is a compensable injury for which he can recover damages.
